TERMS AND CONDITIONS
The following Terms and Conditions constitute the legal basis for the rendering of services by CKGS.
These Terms and Conditions govern the Applicant’s use of the services and are acknowledged as having been read, understood and agreed without any limitation or qualification by the Applicant including full payments. This will also form a part of the Applicant’s contract with CKGS.
No employee of CKGS has any authority whatsoever to change, amend, amplify or withdraw any or all of these Terms and Conditions without prior written approval from CKGS.
These Terms and Conditions also contain a disclaimer which limits CKGS liability to the Refund Policy stated herein below.
The facility of applying through CKGS is open only to Indian passport holders and fulfilling the eligibility conditions announced from time to time by the Government of the concerned countries who offer evisa services. Issuance and approval of a visa is done by regulatory authority of concerned countries whose evisa facilitation service is offered by CKGS and governed by their rules and regulations, subject to the applicant fulfilling the eligibility conditions. These rules are amended/updated from time to time by Government/ concerned authority of respective counties namely Oman, Dubai and Malaysia.
Please note that E-Visa issued by the Government of respective counties namely Oman, Dubai and Malaysia is valid for entry and exit at their respective country’s airport only. This visa is not valid for entry and exit from any other airports.
CKGS role is limited to accepting the E-Visa application as it is merely a service provider. The decision to grant E-Visa rests solely with Government/ concerned authority of respective counties namely Oman, Dubai and Malaysia. CKGS has no role to play in such decision making.
The Applicant will be required to fill out an E-Visa Application Form accurately and submit the same with the applicable visa fees, valid passport and necessary documentation as specified in the Document Checklist. Applicants must hold valid travel documents and comply with the requirements of respective government namely Oman, Dubai and Malaysia for which they intend to apply for evisa.
Each E-Visa Applicant intending to travel to Oman, Dubai and Malaysia and having applied for E-Visa through CKGS should be holding a valid ticket. CKGS will NOT be responsible for and will not be liable for the Applicant not been able to travel due to denied boarding, offloading, cancellation of flight, delays or and any other cause or circumstances.
CKGS does not accept any responsibility for late, lost or misplaced applications and/or the veracity of the contents of the application. Incomplete and double applications will be not be accepted. In case of rejection of E-Visa application, no correspondence will be entertained and no visa fees will be refunded.
The E-Visa is valid as per the Government (concerned authority of respective counties namely Oman, Dubai and Malaysia) rules and regulations as amended from time to time. The E-Visa must be availed within its period of validity.
Applicants will be solely responsible to ensure they fulfil Indian and Oman/Malaysia/ Dubai Governments’ requirements for travel which include police clearance certificate, etc.
The processed E-Visa will be sent to you via email. Please ensure that your correct e-mail address is provided on the E-Visa Application.
Applicants expressly declare that they do understand these terms and conditions and are individuals and not a company or any professional and/or commercial entity.
Payment will be accepted in Visa / Mastercard credit / debit card in USD.
- Convenience charges will apply in case of credit card/debit card payment.
- All fees are non-refundable and will be retained by CKGS on payment by the Applicant even if the Applicant does not make or proceed with the application and whether or not the E-Visa application is granted.
CHANGES TO PROCEDURES AND FEES
Please note that the fees/charges provided will be valid and applicable on the day that they are quoted and provided by CKGS.
CKGS does not accept responsibility for any changes in procedures, rules, documents or fees and reserves the right to pass on any increased fees to the Applicant. If the Applicant decides to make the application on a later date, and/or if the application is in transit, the fees /charges may change.
GRANTING / REJECTION OF VISA
The decision making of an application rests solely with the Government/ concerned authority of respective countries.
The Government reserves the right to grant/deny an application without assigning reasons and the decision is final and binding upon you. CKGS will not be able to help, guide or expedite in the process or reverse a decision.
All fees are non-refundable and will be retained by CKGS on payment by the Applicant even if the Applicant does not proceed with the application and whether or not the E-Visa application is granted.
CKGS has NO DECISION making rights, update on E-Visa status or control in grant/denial/delay of Visa. Hence, NO Refunds will be granted by CKGS including under the following circumstances:
Rejection of E-Visa application, Request for reapplication, Delay in processing E-Visa application, Loss due to Deportation and repatriation for any reason at the point of entry, Lesser duration or number of entries granted for E-Visa, Change in E-Visa fee, Liberalization of Visa policies like No E-Visa Required.
Air tickets, Hotel booking and other related cancellation due to delay or rejection of E-Visa application.
Opportunity loss for time spent on E-Visa application process.
EXCLUSION OF LIABILITY
CKGS BEARS NO RESPONSIBILITY / LIABILITY FOR COSTS INCURRED BY THE APPLICANT IN ANTICIPATION OF AN APPLICATION TO BE FINALISED BY THE CONCERNED MISSION. THESE COSTS MAY INCLUDE BUT ARE NOT LIMITED TO AIR TICKETS OR ANY OTHER TRANSPORT COST, ACCOMMODATION, AND / OR ANY OTHER COSTS. CKGS STRONGLY RECOMMENDS THAT THE APPLICANT MUST NOT MAKE ANY TRAVEL BOOKINGS, UNTIL RECEIPT OF POSITIVE CONFIRMATION OF THE APPLICATION FROM MISSION.
CKGS IS NOT RESPONSIBLE / LIABLE FOR LOSS OR DAMAGE WHICH OCCURS DUE TO ANY EVENT OR INCIDENT WHICH HAPPENS OUTSIDE CKGS’S CONTROL (FORCE MAJEURE EVENTS) AND WHICH IS NOT ATTRIBUTABLE TO ANY ACT OR OMISSION BY CKGS.
CKGS WILL NOT BE HELD RESPONSIBLE / LIABLE FOR ANY LOSS OR DAMAGE, DELAYS CAUSED BY MISSION, PROCESSING AN APPLICATION INCORRECTLY, ATTACHMENT OF WRONG PHOTOGRAPHS, DURATION AND TYPE OF VISA (SINGLE / MULTIPLE ENTRY), ISSUING AN INCORRECT VISA AND/OR INCORRECT DETAILS MENTIONED ON THEM INTER ALIA DUE TO INCOMPLETE APPLICATION FORMS, INCORRECT OR FALSE INFORMATION ON APPLICATION FORM AND INACCURATE AND INCOMPLETE INFORMATION AND SUPPORTING DOCUMENTS PROVIDED BY THE APPLICANT.
UNDER NO CIRCUMSTANCES SHALL CKGS BE HELD RESPONSIBLE OR LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE INCIDENTAL, SPECIAL, CONSEQUENTIAL LOSSES & DAMAGES ARISING WHATSOEVER OUT OF THE SERVICES.
CKGS IS NOT RESPONSIBLE OR LIABLE FOR ANY CLAIMS THAT MAY ARISE IF THE APPLICATION IS RETURNED UNPROCESSED DUE TO INCORRECT UPDATION OF APPLICANT’S DETAILS SUCH AS BUT NOT LIMITED TO ADDRESS, PHONE NUMBER EMAIL ADDRESS AND/OR ANY OTHER INFORMATION FURNISHED BY THE APPLICANT.
SCOPE OF TERMS AND CONDITIONS
CKGS reserves its absolute rights to alter these Terms and Conditions and / or any other documents any time without advance notice and without offering any reason.
CKGS will NOT deal or provide any service or product to any of OFAC(Office of Foreign Assests Control) sanctions countries in accordance with the law of UAE.
As to the interpretation of the foregoing, the decision of CKGS shall be final and binding upon the Applicant.
LAW AND JURISDICTION
Any claims or disputes arising in relation to the services provided by CKGS to the Applicant shall be governed and contrued in accordance with the laws of UAE.
